ill dedicate a full day to this on sunday and up date, just seems weird that the hub should go on sweet with clearance then only bind when tighten down........

It is not weird if you think about what I just explained. Before you tightened the rear hub nut, it spun freely, yes? When you tighten down the hub, it started to bind? What you have done by tightening the rear hub not is seated the hub/rim/tire in another 5-10mm or so towards the rear wheel stand. Which is just enough to have to tire rub on the rear wheel.

How do I know this? Because the first time I set up the Jockey's rear brake, I made the same mistake. After setting the pivot bolt twice and having it bind both times, on the third try I stood behind the scooter and tightened the hub nut and watch it happen.

I tried all day eventually got it sorted and tightened up. Everything clean and followed instructions. Went for blast and five miles later rear wheel binding. Can't trust the set up for 2000 mile euro trip so it's back in the box.

hey net weasel,
i have actually never seen a stand like that!?? but its binding on the shoes, you can see where its happening inside the hub......

I've got a stand like that but it goes nowhere near the tyre.

If you insert them properly from the inside out, they can. If you insert it from the cover side, it will not.
Since mine is set up, I was thinking of tack welding the pivot post to the plate while it is on the scooter, then dissembling it and welding it up proper.
