They might have sent it to the other GAV by mistake.

The courts will hear both sides evidence, then say who can use the name. Until then it is pointless for each side to be printing / posting anything , it's not helping Lambretta, the best motorscooter in the world . Jase WideBoys Lambretta Club England

So, Gavin, when JetSet publishes parts of a letter from Mike Karslake in which he assigns copyright over his BLOA designs to the LCGB, that's a lie, is it? Have we forged the letter from him, as well as his handwriting?

When you claim that we have never made use of the BLOA imagery and we print page after page showing how over the years we have done so repeatedly - and indeed that we have always used the founding year of BLOA to indicate that our Club's history dates back to 1953, we are making things up?

When Brian Capon, John Ronald and Mike Karslake say that they placed the LCGB into trusteeship until a new committee could be found to run it - thereby disproving your argument that that there is no continuity between the "old" and "new" LCGB - they're lying, are they? Any affidavit to that effect from John Ronald and Brian Capon, both of whom are still alive, would be a lie, would it?

When you claim that we have never sold anything with BLOA images on it until the last year or so - and we then publish mugs, badges, legshield banners and other material with BLOA imagery which we have made and sold since the late 1980s, we have just Photoshopped them?

Mike Karslake never bequeathed to the LCGB the Norman Gaze Trophy, first presented by BLOA in 1954 to people who have advanced the Lambretta "cause" and later handed out by the LCGB since 1965? I speak as someone honoured to have received it myself in the past, so be very careful what you say here.

So when we publish quote after quote from you in Jet Set, taken from your bizarre ramblings on Facebook and elsewhere, along with our replies, we're just making those quotes up?

And when you threaten us with legal action, stating that "your client will be liable for defamation of character, which is protected by law", how does that threat square with your constant whingeing that we are the ones threatening you with legal action?

Below is the article in JetSet. Please tell us all which bit of it is untrue and/or made up.

And while you are a it, please tell us which bit of Mike Karslake's own history of the early days of BLOA/LCGB, below, is untrue: http://www.ilambretta.co.uk/history.html

hi
have been reading the now multiple threads on this topic and have done a bit of research.

Mr Frankland is Correct there is no listing under his name or B.L.O.A full club name or acronym on the companies house website

However there is no current listing on the V765/1 list of DVLA Approved owners clubs for the B.L.O.A so a call to DVLA maybe needed to verify if Mr Franklands club is authorised to produce dating Certs
Heres where it gets interesting the following paragraph is from the 2012 IPO( intellectual property office ) hearing between Brandconcern (people behind the new auto lambrettas) and SIL

"30. There are also seven pages from the web site of the Lambretta Club ofGreat Britain from 2003, which have been obtained from a web archive search.
These show the use of Club’s name, or the name ‘British Lambretta Owners Association’, in relation to the sale of T-shirts, baseball caps, polo shirts and fleeces
"

so the IPO have recognised usage of the name B.L.O. A by the LCGB in 2012 and one might assume the logos/ badges associated with it on the merchandise mentioned above.
this casts significant doubt over the claims the LCGB have only just started using BLOA branded merchandise to counter Mr Franklands venture by Mr Frankland and his supporters.

"The following information has been updated: (HMOSE) on (2017/01/05:15:18:03).
The previous version of the mark section was as follows:
Type of Mark: Word Mark
Series: No
Trademark Type: Standard
Mark Texts: British Lambretta Owners Association
Disclaimer: Exclusive rights the name British Lambretta Owners Association, also known as B.L.O.A and all printed, embroidery material covering the Lambretta Lion and shield."
the information above has been taken from mr Franklands application to the IPO,
it shows he has applied for the name BLOA only, not the badges or logos which Mike Karslake owned and gave to LCGB for use to the benefit of that organisation as stated in jetset
the status of this trademark application is "opposed" and not Registered to date. Meaning an IPO hearing will take place to resolve this unless parties resolve it through mediation

i was quite surprised by what i had discovered that Mr Frankland has tried to claim ownership of the "lambretta Lion Badge on printed and embroidery " by this i take it as the golden lion rampant against the st georges cross with word lambretta above ,something that has been in continuous use by the LCGB and many other scooter merchandise sellers since at least 1985 when i first started my interest in lambrettas.

Mr Frankland has not mentioned this in his posts about his attempt to acquire this logo which i feel it is quite an important thing given the wide use of this Logo and the financial consequences of giving one individual its sole right of usage.

MR frankland has not shown in his posts any clear right to sole use of the the BLOA logos / badges that Mike Karslake designed .as his trademark application clearly shows he only applied for the "words British lambretta owners association and the "Lambretta lion" logo to be his alone.
So why produce items and advertise in scootering publications using such logos/ bagdes especially as they are not the logo he has sought to trademark?

I also feel there is a lot more to this in legal terms as none of the "scootering press " have touched this hot potato , another blow for investigative journalism !!

It does seem just daft to provoke conflict and one thing im sure is it will all end in tears with ordinary scooterists taking a hit no doubt.
