The son in law and I decided to go for a little ride out yesterday on our scoots, but thanks to some t**t texting while driving we didn't get far. He admitted it to us straight away, but by the time it came swapping details he denied it. His word against ours, and without witnesses hard to prove. Anyway, we are left with one set of twisted forks, a buckled tubeless rim, smashed mudguard and cracked headset as a result. I seriously think people using a phone when driving should get an instant 6 month ban.

As cops have to be informed anyway they can check the phone records ( if they can be bothered)

Well, I suppose you could threaten to get the police involved. If he was texting then his provider will have a record of it. I'm not sure if it would stick, or if the police could even be arsed, but you could bluff and see if his nerve cracks first. It just goes to show why so many riders have helmet cams these days. If you've got it on tape he's screwed.

Agree with the instant ban. Not a day goes by when you don't see some w****r on their mobile while driving.

The police weren't interested. Just told us to swap details and let our insurers sort it out. They have neither the resources or inclination to investigate minor RTA's.

Sorry to read this.

The Police's response is understandable but appalling! A little intervention at this stage could save them a lot of paperwork when it results in a fatality the next time.

It's an "accident" that's not your fault, go straight to a decent bike friendly solicitor and tell them exactly what happened - they'll happily go for it and go after the wan%er - using a phone while driving was the cause of this ad that is illegal, it might be your word against his but the solicitor will get to the bottom and will involve the police (if necessary).
A bike friendly solicitor will love this!

We were at a junction waiting to turn right he, cut across the junction turning in and clipped the front of the scoot. It could of been a lot worse I suppose.
