Re: Name change- British Lambretta Owners Association Club

wise words WM. Funnily enough although the VCB and VOC have an understanding it was clearly because the VOC spoke to the VCB at some point t before running away with the idea and also made their logos and name measurably dissimilar. Many, many years ago I re-started a local Vespa Ciub and mistakenly...

Re: Name change- British Lambretta Owners Association Club

To be fair, any specialist knowledge about what a likely court outcome will produce will be run past a barrister at some point if you're serious about it ending up in court as a real possibility. Only a barrister would know what the sort of scenario & outcomes is likely to be in the real world/p...

Re: Name change- British Lambretta Owners Association Club

The copyright is for the images not the trademark, I have mentioned this previously at least once.
The images have been used by the LCGB continuously on products and in published articles, I have several of these products myself.

Re: Name change- British Lambretta Owners Association Club

The only fly in that analogy (and it's a rather large one) is the fact that the owner did indeed sign over rights to 'it' and therefore it was never the fellas to take from the field.
As for 'and now it's flourishing and looks great'- okaaaaay.

Re: Name change- British Lambretta Owners Association Club

No one registered it on his behalf -I understand the confusion to be fair, since Gavin himself claimed more than once to 'own' BLOA. He never did and doesn't now. He might if he wins in court however and the IPO might accept this, but that's pretty unlikely. He may well have used another logo that d...

Re: Name change- British Lambretta Owners Association Club

What was 'sold' to him?
By whom?

If you mean the fee for registering the trademark it wasn't sold, it's a fee for registration.
He doesn't own the trademark currently.

Re: Name change- British Lambretta Owners Association Club

The first is disputed legally. The second has been accepted by all parties to the dispute. Okay, so we can dispense with the second point, as it no longer seems to be an issue. As regards the first point you're basically suggesting he bought a dodgy motor, is that it? WM has answered this point bet...

Re: Name change- British Lambretta Owners Association Club

Good points WM! The new BLOC logo is, in fact, a design by the Lambretta club d'Italia, (albeit without the wording as Gavin has used) it is relatively recent too and the logo itself is used on all their own club merchandise. I seriously don't get what the attraction is with using someone elses logo...

Re: Name change- British Lambretta Owners Association Club

He applied for a trademark on the name and the name alone. He then went ahead and copied images and logos which weren't his to use without permission or even checking these were not legally owned by anyone else. The first is disputed legally. The second has been accepted by all parties to the disput...

Re: Name change- British Lambretta Owners Association Club

FWIW Eden one can only be as active as their own life allows them to be. Nic cares passionately about the LCGB & that is self evident, as do I, neither of us have anything to prove with our tachometers or rally patches/badges and I wouldn't presume to point the same sort of accusation at the per...
