Re: Name change- British Lambretta Owners Association Club

From what I’ve read, most people feel the onus was on the committee to contact him, rather than vice versa. This being because he was happy with his own actions, but they were not. Given they were the aggrieved party, and the ones instigating legal advice/recourse, I can see how that opinion might ...

Re: Name change- British Lambretta Owners Association Club

I think it's a shame GF couldn't have communicated directly as this would have avoided any doubt or misinterpretation, but we are where we are. From what I’ve read, most people feel the onus was on the committee to contact him, rather than vice versa. This being because he was happy with his own ac...

Re: Name change- British Lambretta Owners Association Club

You could just sign over the trademark over to the LCGB as the objecting party?

There is no benefit to you retaining that trademark as that will only fuel this current situation.

BLOC is a bit close to the wire but it is a step forward.

Re: Name change- British Lambretta Owners Association Club

Again, what is the point of changing the name but not dropping the claim to the words British Lambretta Owners Association? It cannot be acceptable for you to hold the trademark on that name as you have already played tricks to remove the LCGB club items from eBay. Surely if the aim was truly a club...

Re: Name change- British Lambretta Owners Association Club

Straight question Gavin, you have changed the name to keep 'harmony' within the Lambretta scene which is a positive move. However, I am still seeing comments that you will 'not back down' and that you own BLOA 'legally'. Surely all there is to do is to drop the Trademark application and then we can ...

Re: Name change- British Lambretta Owners Association Club

The only fly in that analogy (and it's a rather large one) is the fact that the owner did indeed sign over rights to 'it' Not really. Giving someone written permission to use something, is not the same as legally signing over the rights. Didn't Mike Karslake infer that all copyright remained with h...

Re: Name change- British Lambretta Owners Association Club

It's not being given a chance to flourish. The analogy Arcadia outlines is and has always been how I view this. BLOA had been assigned to history by LCGB. Why don't others want BLOA to be given a new lease of life? LCGB can't do it as they are LCGB, How many hats do LCGB want to wear? Kentucky Frie...

Re: Name change- British Lambretta Owners Association Club

I have a scooter I am currently collecting parts on, if someone just wheeled that out of my garage because it didn't look like I was doing very much with it that wouldn't wash with many people on here. So why should imagery (which is owned and signed away by the creator) be fair game just because i...

Re: Name change- British Lambretta Owners Association Club

Yes, I get that. But it was sold to him. So the analogy does hold some water. It wasn't sold to him, he paid the registration fee. So he basically paid the £50 to the DVLA to register a scooter that lay unregistered. Again without any consideration for the person whose garage it sat in. The IPO rec...

Re: Name change- British Lambretta Owners Association Club

The first is disputed legally. The second has been accepted by all parties to the dispute. Okay, so we can dispense with the second point, as it no longer seems to be an issue. As regards the first point you're basically suggesting he bought a dodgy motor, is that it? No, using my analogy, he effec...
